Terms of Service

1. Acceptance of Terms
By accessing or using Call Whisperer ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Call Whisperer is an AI-powered sales coaching platform that enables users to practice sales calls with simulated AI prospects. The Service provides real-time coaching suggestions, post-session analysis, and performance scoring to help sales professionals improve their skills.
3. Account Registration
To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when creating your account and to update your information as necessary to keep it current.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to manipulate, reverse engineer, or exploit the AI coaching system
- Share, sell, or redistribute AI-generated coaching content as your own product
- Create multiple accounts to circumvent usage limits
- Use automated tools or bots to interact with the Service
- Transmit offensive, harmful, or inappropriate content during practice sessions
- Interfere with or disrupt the Service or its infrastructure
5. Usage Limits
The Service includes configurable usage limits on practice sessions, including daily and weekly session caps and maximum session duration. These limits may be adjusted at our discretion. Attempting to circumvent usage limits may result in account suspension or termination.
6. AI-Generated Content
The coaching suggestions, scripts, and analysis provided by the Service are generated by artificial intelligence and are intended for educational and practice purposes only. This content:
- Does not constitute professional sales training or business advice
- May not be accurate, complete, or suitable for every sales situation
- Should be used as a supplement to, not a replacement for, professional development
- Does not guarantee any particular sales outcomes or results
7. Call Recording and Transcription
By using the Service, you consent to the recording and transcription of your practice sessions. These recordings and transcripts are used to generate coaching feedback, session analysis, and to improve the Service. You acknowledge that practice sessions involve AI-simulated conversations, not real prospects.
8. Live Client Calls
If you use Call Whisperer's live-calling feature, you may place real telephone calls to third parties through the Service. Those calls may be recorded, streamed, transcribed, analysed, and processed by Call Whisperer and its providers so that the Service can provide real-time coaching, call notes, summaries, quality analysis, abuse prevention, support, and service improvement.
You are solely responsible for your calls and for complying with all laws and regulations that apply to them, including call-recording and monitoring consent laws, telemarketing and do-not-call rules, data-protection and privacy laws, and any workplace or customer-notice requirements. Before using live calls, and before any recording, transcription, monitoring, or AI analysis begins, you must obtain all consents and give all notices required from every person on the call.
Because consent rules vary by location and some jurisdictions require consent from all parties, you agree to follow the strictest consent standard that may apply to your call unless you have confirmed a different lawful basis with your own legal adviser. At a minimum, you must not use live calls unless every call participant has been told that the call may be recorded, transcribed, monitored, and analysed by AI for coaching purposes, and has consented where consent is required.
If you or the person you call is in the United Kingdom, European Economic Area, or another jurisdiction with data-protection laws, you are responsible for ensuring that you have a lawful basis to process the call participant's personal data, that you provide any required privacy notice, and that your use of the Service is consistent with your own data-protection obligations.
You represent and warrant that: (a) you have the right and authority to place each live call; (b) any caller ID or telephone number you register or use is one you are authorised to use; (c) you have obtained and will maintain all required consents, notices, permissions, and lawful bases for recording, transcription, monitoring, AI analysis, and processing of each live call; and (d) your live calls will not violate any telemarketing, do-not-call, recording, monitoring, privacy, employment, or data-protection law.
You agree to indemnify, defend, and hold Call Whisperer harmless from any claim, loss, liability, penalty, fine, cost, or expense arising from your live calls, your caller-ID or telephone-number use, your failure to obtain required consent or provide required notices, or your violation of applicable law. Call Whisperer is not a party to your live calls and does not provide legal advice about consent, telemarketing, privacy, or data-protection requirements.
Restricted destinations. Live calls can only be placed to countries, territories, and number types that Call Whisperer supports. We block destinations and number ranges that we designate as restricted, which may include personal-numbering ranges, premium-rate ranges, directory-enquiry services, high-cost routes, fraud-prone routes, sanctioned or unsupported countries, and other destinations that present legal, security, fraud, cost, carrier, or operational risk. Restricted destinations cannot be dialled. We may update supported and restricted destinations from time to time, including immediately where needed for security, fraud prevention, carrier, legal, cost-control, or operational reasons; where a change materially affects paid live-calling functionality, we will provide notice where required by law or where reasonably practicable. Attempts to call restricted destinations are logged, including the number dialled, account/user identifiers, timestamps, and the restriction reason where available, for security, fraud prevention, abuse prevention, billing/dispute handling, support, compliance, and service-improvement purposes.
9. Intellectual Property
The Service, including its design, features, AI models, and content, is owned by Call Whisperer and protected by intellectual property laws. You retain ownership of any original content you provide. You grant us a license to use your practice session data to operate and improve the Service.
10. Trial, Free Access, and Paid Subscription
The Service may offer a limited introductory practice allowance (a "usage trial") when you start a paid plan through hosted Stripe Checkout and provide a payment method. Trial terms (for example duration and practice minutes) are shown at checkout and in your account billing settings. We may modify trial parameters for future signups.
Unless you cancel before the trial ends, your subscription automatically converts to a paid monthly plan and you will be charged the then-current plan price (for example Starter or Pro) using the payment method on file. If you use all trial practice minutes before the trial calendar period ends, you may start the paid subscription immediately (for example by confirming start of paid access in the app) so you can continue practicing without waiting for the trial clock to expire. Starting paid access early authorizes us to begin paid billing for that plan according to the checkout and billing screens you confirm. How to cancel is disclosed when you start the trial (standard subscription practice) and remains available through account billing settings and the Stripe Customer Portal; a cancel control need not appear next to an early-start confirmation.
There is no unlimited free monthly practice pool. After the trial ends—or after you start paid access early—new practice sessions require an active paid subscription (or another paid entitlement we offer). You may still access your account and prior session history subject to these Terms.
Trial practice minutes do not carry over into a paid subscription. Any unused trial minutes expire when the trial ends or when you start paid access early. Your paid plan then provides a new allowance for that plan and billing period; unused trial minutes have no cash value and are not added to paid minute pools.
Paid subscriptions are billed monthly through Stripe. Call Whisperer does not collect or store raw card details. You can manage payment methods and cancellation through the Stripe Customer Portal from account billing settings. Cancel before the trial ends to avoid the first paid charge. Cancel before the next renewal date to avoid future charges after you are on a paid plan. Current paid billing periods are generally non-refundable except as described in the Refund and Cancellation Policy.
We may also offer limited no-card previews for marketing or evaluation. Any such preview is separate from a card-backed trial and may be modified or discontinued at any time.
10A. Credit Terms (purchased packs)
We may offer prepaid credit packs (for example practice or live-call usage credits) for purchase through the Service. Completing a purchase (including by clicking Pay now or completing Stripe Checkout) authorizes us (via our payment processor) to charge the payment method you provide for the amount confirmed at checkout, and constitutes your agreement to these Credit Terms.
Purchased credits are for use of the Service as described at purchase (for example practice and/or live-call usage). They are separate from any monthly plan allowance. Monthly plan minutes reset according to your subscription period and are not the same as purchased credit packs.
Each purchased credit pack is valid for three hundred sixty-five (365) days from the date of purchase. Unused credits expire at the end of that period. Expired or unused credits have no cash value and are not redeemable, transferable, or exchangeable for cash except where required by law. We do not offer permanent or never-expiring credit packs. When you hold more than one pack, we consume the oldest remaining purchased credits first (FIFO).
Purchased credit packs are non-refundable once paid, including if you cancel a subscription, stop using the Service, or leave credits unused until expiry. This does not affect rights that cannot be excluded under applicable law. We may, at our discretion, correct clear billing mistakes or issue a refund or credit in limited cases; that is not an entitlement and is not a published menu of refund scenarios. We may send reminder emails before pack expiry (for example about 30 days and about 7 days before unused credits expire), provided a remaining balance and a valid account email. Reminder emails are a courtesy only. Expiry still applies if a reminder is delayed, missed, blocked, or not received; on expiry we zero remaining balance and record the burn.
Canceling a subscription does not convert remaining credits into cash. Whether you can still use remaining credits after cancellation depends on whether your account remains entitled to start relevant sessions under these Terms and the product rules then in force.
11. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. In no event shall Call Whisperer be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time for violations of these terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time and for any reason, at our sole discretion. Changes take effect immediately upon being posted to this page. We may, but are not obligated to, notify you of changes through the Service or via email. It is your responsibility to review these Terms periodically. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
